Quit claim deeds in Arkansas are governed by A.C.A. § 18-12-102 (2012). By omitting the words "grant, bargain, and sell," the statutory language that contains an implied warranty, this type of conveyance only transfers the grantor’s immediate legal rights and interests in a specific parcel. There is, however, a good-faith presumption that the grantor is not aware of any other owners or conflicts over who holds title to the real property. A correctly executed quit claim deed provides no protection for the grantee in the event of a future claim.
