In Massachusetts, a conveyance of property can be conducted with various real estate documents. One such document, a deed of quitclaim and release, is sufficient to convey all the estate which the grantor could legally convey by a deed of bargain and sale (183.2). A quitclaim deed provides covenants on the part of the grantor that at the time of delivery of the deed, the premises were free from all encumbrances made by him, and that he, his heirs, and administrators, will warrant and defend the same to the grantee, his heirs and assigns forever, against the lawful claims and demands of all persons claiming by, through, or under the grantor (183.11). These covenants are known as "quit claim covenants" or "limited covenants" (183.17). No covenant is implied from the use of the word "grant" as used in a conveyance (183.12). |
