In Mississippi, a conveyance without a warranty clause will operate as a quit claim and release (89-1-37). A deed of quit claim and release is sufficient to pass all the grantor’s estate or interest in the land conveyed. This type of Mississippi real estate deed prohibits the grantor and his heirs from asserting a subsequently acquired adverse title to the lands conveyed (89-1-39). In the Mississippi Code, forms for conveyances of land are provided in 89-1-61. In the statutory form, the words “quitclaim and release” should replace "convey and warrant," as a quit claim deed does not include warranties. |
