Quitclaim Deed Recording Information for Harrison County, Mississippi
A conveyance of quitclaim and release shall be sufficient to pass all the estate or interest the grantor has in the land conveyed, and shall estop the grantor and his heirs from asserting a subsequently acquired adverse title to the lands conveyed.
In preparing a quitclaim deed, the following rules apply:
1. A quitclaim deed shall consist of one or more individual pages printed only on one side.
2. The first page should have a top margin of 3 inches. This area is reserved for the recording information and is to be left blank. All other margins should be ¾ of an inch to 1 inch.
3. The font size must be at least 8 point, but the Harrison County Chancery Clerk prefers 10 point font.
4. The numbering of pages is not required, but is helpful. Page numbers can be in the margins of the page.
5. The grantors and grantees must be listed, along with required addresses and phone numbers, on the first page of the quitclaim deed.
6. The legal description of the property shall be contained in a separate page and should be labeled as “Exhibit A.” If there is sufficient space, the legal description and indexing information can be on the first page of the quitclaim deed.
7. The document preparer’s name, phone number, and address should be listed below the 3-inch margin on the first page and on the left side, just above the document title. On the right side of the first page, also below the 3 inch margin and above the document title, the return to name and address information should be listed. “Quitclaim Deed” would be a sufficient title.
8. Signatures must be in black or blue ink. Names should be printed or typed beneath signatures.
Statutory form for a quitclaim deed:
“In consideration of [here state it], I quitclaim to the land
described as [describe it].”
“Witness my signature, the day of , A. D. .”
RECORDING FEES
To record a quitclaim deed, the fee is $13 for the first 15 pages and $1 for each additional page.
For each abstracting per section or subdivision lot, the fee is $1.
The mineral tax, per net acre is $ .08. The mineral tax minimum is $1. All mineral tax costs must be paid in a separate check.
